Seller damaged game in shipping - what can I do?

RAGE.

So I order a copy of Xmen vs Street Fighter for the Saturn. The seller was a little too enthusiastic about packaging. He decided that since discs sometimes come loose in transit that maybe he should put a piece of scotch tape on the disc to hold it in place...

THIS IS WHAT HAPPENED:

The damage even extends a little past the cosmetic ring of silver. I don't know if any of the data is damaged but to be honest, I don't care. I've sent the guy an email about it but I'll be honest - I don't want the game in THIS condition and I don't want to pay the shipping back to him. Fuck him.

So what should I do? Go to ebay or make demands from him?

First wait to see what the seller says. I have had this happen to me twice.

Once the seller said sorry and that I can keep the product and he gave me a refund.

The other time (which was recent) the seller pretty much said too bad, I left negative feedback because of his attitude, in the end the what I bought was too cheap to bother sending back for a refund and it wasnt worth the effort to contact ebay over. Shit happens sometimes.

Just above the NTSCJ stamp the foil of the disc has been ripped off, evntually this will cause disc rot.

some of the black stuff in the middle looks like it ripped off due to the tape. but isnt that just paint?

No, its the foil that seals the top of the disc. Not that it's ripped it means the damage will easily spread into the data section of the disc. Not to mention that it exposes more of the disc to oxygen (the key culprit in disc rot) than should be the case.

Edit: Not to mention it's not what I paid for.

I know its not what you paid for. I just didnt understand that the paint also sealed the top of the disc. so to me, i thought it was just cosmetic. woops

Yeah, that's crap. Must not have been plain old cloudy scotch tape if it did that. The proper answer is put a folded up tissue or piece of bble wrap or something in there if you're concerned. But in a regular jewel case, if it pops free it doesn't have enough room to move much. I suspect the teeth were already all broken though unless the package itself was really beat up.

The game should probably play fine since it's way in the middle, but it will let air in and will start to slowly rot now. :(

I'd contact the seller and hopefully they'll be reasonable.

Okay somehow I got the only reasonable seller on ebay who is ALSO dumb enough to put tape on the game. He's sending a shipping label and offering a full refund.

And I was gearing up for a fight...
